1. Introduction
Welcome to Templass. These Terms of Service ("Terms", "ToS") govern your use of Templass DDoS protection services ("Services") provided by Templass ("we", "us", "our"). By accessing or using our Services, you ("Customer", "you", "your") agree to be bound by these Terms.
If you do not agree to these Terms, you must not use our Services.
2. Definitions
- "Services" means the DDoS protection, traffic filtering, and network security services provided by Templass, including but not limited to Layer 3/4 and Layer 7 protection, GRE tunnel and reverse proxy solutions, traffic monitoring, and attack mitigation.
- "Customer" means any individual or entity that uses or purchases our Services.
- "End-User" means any third party that accesses or uses services protected by Templass through the Customer.
- "Reselling" means the Customer's provision of Templass Services to third parties, whether as part of a hosting service, managed service, or other commercial offering.
- "Acceptable Use Policy" or "AUP" refers to the rules and restrictions governing the use of our Services as set forth in Section 5.
3. Scope of Service
Templass provides DDoS protection and traffic filtering services designed to mitigate distributed denial-of-service attacks and filter malicious network traffic. Our Services may include:
- Network-layer (Layer 3/4) DDoS protection
- Application-layer (Layer 7) DDoS protection
- Traffic filtering and attack mitigation
- Real-time monitoring and alerting
- GRE tunnel or reverse proxy deployment options
- Traffic analysis and reporting
Service Limitations:
- Templass cannot guarantee 100% protection against all DDoS attacks, 100% network uptime, or zero packet loss.
- Protection effectiveness may vary depending on attack type, size, and complexity.
- Attacks may still cause service slowdowns, temporary interruptions, or routing changes.
- Protection effectiveness depends on correct Customer configuration, infrastructure setup, and cooperation with our technical requirements.
- The specific scope and features of Services are defined in your service agreement, order confirmation, or service plan.
4. Account Registration & Eligibility
To use our Services, you must:
- Be at least 18 years old or have the legal capacity to enter into contracts in your jurisdiction.
- Provide accurate, complete, and current information during registration.
- Maintain and update your account information to ensure it remains accurate.
- Be responsible for maintaining the confidentiality of your account credentials.
- Notify us immediately of any unauthorized access to your account.
We reserve the right to refuse service, suspend accounts, or terminate accounts at our sole discretion, particularly in cases of fraud, abuse, or violation of these Terms.
5. Acceptable Use Policy (AUP)
You agree not to use Templass Services for any illegal, harmful, or unauthorized purpose. The following activities are strictly prohibited:
Prohibited Activities:
- DDoS Attacks and Offensive Security: Using Templass Services to launch DDoS attacks, operate booters or stressers, or engage in any offensive security activities against third parties.
- Botnets and Malware: Operating botnets, distributing malware, or facilitating unauthorized access to computer systems.
- Unauthorized Access: Hacking, cracking, or attempting to gain unauthorized access to any system, network, or data.
- Spam and Phishing: Sending unsolicited bulk messages (spam), phishing emails, or engaging in fraudulent activities.
- Illegal Content: Hosting, distributing, or facilitating access to illegal content under German or EU law, including but not limited to:
- Child exploitation material
- Extremist or terrorist content
- Copyright-infringing material (without proper authorization)
- Law Violations: Any activity that violates applicable laws, regulations, or third-party rights.
- Network Abuse: Activities that abuse, overload, or disrupt our network infrastructure or the networks of other customers.
Consequences of Violation:
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your Services without prior notice and without refund. We may also report violations to law enforcement authorities where appropriate.
6. Reselling and Sub-Users
Reselling Permitted:
Reselling of Templass Services is generally permitted, provided that:
- You comply with these Terms of Service and our Acceptable Use Policy.
- You are responsible for the behavior, traffic, and compliance of all your end-users and sub-customers.
- You ensure that your end-users do not violate these Terms or our Acceptable Use Policy.
- You maintain appropriate oversight and control over resold Services.
Customer Responsibility:
You are fully responsible for all activities, traffic, and content associated with your account and any resold Services, including activities by your end-users. You agree to indemnify Templass against any claims, damages, or liabilities arising from your or your end-users' use of the Services.
Reselling Restrictions:
We reserve the right to restrict, suspend, or revoke reselling rights in cases of:
- Abuse or violation of these Terms or our Acceptable Use Policy
- Network risk or threat to our infrastructure or other customers
- Non-payment or payment disputes
- Any other reason we deem necessary to protect our network, customers, or business
7. Payments, Billing & No-Refund Policy
Billing:
- Services are typically billed on a monthly subscription basis, unless otherwise agreed in writing.
- Billing cycles begin on the date of service activation or as specified in your service agreement.
- Subscriptions automatically renew unless cancelled in accordance with our cancellation policy.
- All fees are due in advance unless otherwise specified.
- Payment is due within the timeframe specified in your invoice (typically 14 days).
Payment Methods:
We accept payment via the methods specified during checkout or in your service agreement. You agree to provide valid payment information and authorize us to charge your payment method for all fees.
No Refund Policy:
All payments for Templass digital protection services are final. No refunds will be provided, except where mandatory statutory rights under German law apply, including but not limited to:
- Dissatisfaction with protection effectiveness or performance
- Attack size exceeding expectations or service capacity
- Configuration problems or errors on the Customer's side
- Early termination by the Customer
- Service suspension or termination due to violation of these Terms
- Changes in Customer requirements or business needs
Digital Services and Right of Withdrawal:
Under EU and German law, consumers may have a right of withdrawal for certain digital services. However, this right is excluded for digital services that have been fully provided or started with the consumer's explicit consent before the withdrawal period expires.
By ordering and using Templass Services, you explicitly consent to the immediate commencement of service provision and acknowledge that:
- The service begins immediately upon activation or provisioning
- You waive your right of withdrawal once the service has been fully provided or started
- No refunds will be provided once service activation has occurred
Chargebacks:
If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we reserve the right to immediately suspend or terminate your Services. We may also charge reasonable fees to cover the costs associated with processing the chargeback.
Late Payment:
If payment is not received by the due date:
- We may charge late fees and default interest as permitted by law
- We may suspend Services after providing reasonable notice
- We may terminate Services and pursue collection of outstanding amounts
8. Fair Use & Network Protection
Fair Use:
- Our Services are subject to fair use policies and reasonable usage limits based on your service plan.
- Extremely large or repeated attacks may require plan upgrades or special agreements.
- We reserve the right to review usage patterns and may contact you if usage exceeds normal expectations for your plan.
Network Protection:
To maintain network stability and protect all customers, Templass may:
- Temporarily rate-limit or throttle certain traffic during attacks or network stress
- Block or filter traffic that poses a risk to our network or other customers
- Suspend or limit Services to specific customers if their traffic threatens overall network stability
- Implement traffic shaping or routing changes as necessary
These measures are taken at our sole discretion and are not grounds for refunds or service credits unless otherwise specified in a separate SLA.
9. Suspension and Termination
Suspension:
We may suspend your Services immediately, without prior notice, if:
- You violate these Terms or our Acceptable Use Policy
- You fail to pay fees when due
- Your account poses a security risk or threat to our network
- We suspect fraudulent or illegal activity
- Required by law or court order
Termination by Customer:
You may terminate your Services by:
- Providing written notice as specified in your service agreement (typically 30 days)
- Cancelling through your account dashboard if available
- Contacting our support team
Termination by Templass:
We may terminate your Services:
- Immediately for material breach of these Terms or Acceptable Use Policy violations
- With reasonable notice (typically 30 days) for other reasons
- Immediately if required by law or court order
Effect of Termination:
Upon termination:
- Your access to Services will cease
- You must immediately stop using Templass infrastructure and remove any configurations
- All outstanding fees remain due and payable
- We may delete your account data in accordance with our data retention policies
- No refunds will be provided for any remaining service period
10. Data Protection & Privacy
Privacy Policy:
Templass processes personal data in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
Detailed information about how we collect, use, and protect your data is provided in our separate Privacy Policy, which forms part of these Terms by reference.
Data Processing:
In providing DDoS protection services, Templass may process:
- Network traffic data and connection metadata
- IP addresses and routing information
- Attack patterns and security logs
- Account and billing information
- Communication records
This processing is necessary for service provision and is based on:
- Contractual necessity (Art. 6(1)(b) GDPR)
- Legitimate interests in providing security services (Art. 6(1)(f) GDPR)
- Legal obligations (Art. 6(1)(c) GDPR)
Customer Responsibilities:
You are responsible for ensuring that your use of Services complies with applicable data protection laws regarding your end-users' data. You must obtain necessary consents and provide appropriate privacy notices to your end-users.
11. Customer Responsibilities
You agree to:
- Configuration: Properly configure your infrastructure and follow our technical requirements and documentation
- Cooperation: Cooperate with our technical support team and provide necessary information for troubleshooting
- Security: Maintain appropriate security measures on your own infrastructure
- Compliance: Comply with all applicable laws, regulations, and these Terms
- Notification: Promptly notify us of security incidents, suspected attacks, or service issues
- Payment: Pay all fees in accordance with payment terms
- Account Security: Maintain the security of your account credentials and notify us of unauthorized access
12. Intellectual Property
Templass Intellectual Property:
All intellectual property rights in the Services, including software, systems, documentation, trademarks, and proprietary technology, remain the exclusive property of Templass or its licensors.
License to Use:
Subject to these Terms, Templass grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for the duration of your service agreement. This license terminates upon termination of your Services.
Customer Content:
You retain ownership of any content, data, or materials you provide to us. By using our Services, you grant Templass a limited license to use, process, and transmit your data as necessary to provide the Services.
13. Disclaimers and Limitation of Liability
Service Disclaimer:
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Limitation of Liability:
To the maximum extent permitted by applicable law:
- Unlimited Liability: Templass is fully liable for damages resulting from:
- Intent or gross negligence
- Injury to life, body, or health
- Liability under the German Product Liability Act (ProdHaftG)
- Breach of essential contractual obligations ("Kardinalpflichten") due to slight negligence
- Limited Liability: For other cases of slight negligence, Templass's liability is limited to:
- Typical, foreseeable damages
- The amount of fees paid by the Customer in the 12 months preceding the damage event
- Exclusion: Templass is not liable for:
- Indirect damages, lost profits, or consequential damages
- Data loss (unless caused by gross negligence or intent)
- Damages resulting from attacks that bypass or overwhelm protection measures
- Damages resulting from Customer configuration errors or non-compliance with our requirements
Force Majeure:
Templass is not liable for delays or failures in performance due to circumstances beyond reasonable control, including natural disasters, war, terrorism, internet infrastructure failures, government actions, or third-party service failures.
14. Indemnification
You agree to indemnify, defend, and hold harmless Templass, its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the Services
- Your violation of these Terms or our Acceptable Use Policy
- Your violation of any law or third-party rights
- Activities by your end-users or sub-customers
- Your content, data, or materials
15. Governing Law & Jurisdiction
Governing Law:
These Terms are governed by the laws of the Federal Republic of Germany, excluding:
- The UN Convention on Contracts for the International Sale of Goods (CISG)
- Conflict-of-law rules that would apply the law of another jurisdiction
Jurisdiction:
For merchants ("Kaufleute") within the meaning of the German Commercial Code (HGB), legal entities under public law, or special funds under public law:
- The exclusive place of jurisdiction is the competent court at Templass's registered seat in Germany.
For consumers:
- Mandatory consumer protection laws and jurisdictions under EU and German law apply.
- Consumers may bring claims in their country of residence or in Germany, as permitted by applicable consumer protection laws.
Dispute Resolution:
Before initiating formal legal proceedings, parties agree to attempt to resolve disputes through good faith negotiation. If negotiation fails, disputes shall be resolved through the competent courts as specified above.
16. Changes to these Terms
Modification Rights:
Templass reserves the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on our website
- Sending notice to your registered email address
- Providing notice through your account dashboard
Acceptance of Changes:
- For Consumers: If you are a consumer, material changes will be clearly communicated, and you may have the right to terminate your Services if you do not agree to the changes.
- For Businesses: Continued use of Services after notice of changes constitutes acceptance of the modified Terms.
Effective Date:
Changes become effective as specified in the notice, typically 30 days after notification, unless immediate changes are required by law or for security reasons.

18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that comes closest to the economic intent of the invalid provision.
19. Entire Agreement
These Terms, together with your service agreement, order confirmation, and our Privacy Policy, constitute the entire agreement between you and Templass regarding the Services and supersede all prior agreements, understandings, or communications.

By using Templass Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
